Terms of service
Effective October 6, 2026
These terms are the agreement between you and Twynela LLC, a Texas limited liability company doing business as Twynela ("Twynela", "we", "us"), for your use of twynela.com and any purchase you make from us. Please read them. By using the site or placing an order, you agree to them. If you do not agree, do not use the site.
1. Who can buy
You must be 18 or older to place an order. By ordering you confirm that you are, and that the information you give us is accurate. We sell and ship within the United States only. See the Shipping Policy for the states we serve.
2. What we sell
Twynela makes original fragrance compositions. Each one starts from a familiar scent direction and changes one thing on purpose. We call that change The Turn. Our products are our own formulations. They are not made by, licensed by, affiliated with, sponsored by or endorsed by any other fragrance house, and they are not copies of any other product. Where a product page names another fragrance, it does so only to tell you which direction inspired ours. See Legal notices.
Scent is personal. How a fragrance smells, how long it lasts and how it develops depends on your skin, the weather and how much you apply. Our descriptions are honest accounts of what we smell on us, not promises about how it will behave on you. The First Turn sample set exists so you can test before you commit to a bottle.
3. Orders, prices and payment
Prices are in US dollars and exclude sales tax and shipping, which are shown at checkout before you pay. We can change prices at any time, but a change never affects an order we have already accepted.
Your order is an offer to buy. We accept it when we ship it and send a shipping confirmation. We may refuse or cancel an order, in whole or in part, before shipment for any lawful reason, including a pricing or description error, a suspected fraud or reseller order, a quantity limit, or because an item is out of stock. If we cancel after you have paid, we refund you in full.
If a product is listed at an obviously wrong price, we may cancel the order and tell you why, even if we have already sent an order confirmation.
Payment is processed by Shopify Payments, Shop Pay, PayPal and the other methods shown at checkout. We never see or store your full card number. By paying you confirm that you are authorized to use the payment method.
4. Shipping, risk and delivery
Our fragrances contain alcohol and are classified as a flammable liquid for transport. That is why they travel by ground only, never by air, and why we ship only to addresses the ground network reaches. Delivery estimates are estimates. If a package arrives damaged or does not arrive, tell us within 14 days of the expected delivery date and we will replace it or refund it. Details are in the Shipping Policy.
5. Returns
Unopened bottles with the seal intact can be returned within 30 days. Opened fragrance cannot be returned, because we cannot resell it and because it cannot be mailed back by air. The full rules, including what happens when we make a mistake, are in the Refund Policy.
6. The sample set credit and discount codes
When you buy the First Turn sample set we give you a code worth the price of the set, good toward one 30 ml bottle. The code is for one use, by the customer who bought the set, within 90 days of the set's order date. It cannot be combined with another code, applied to another sample set, exchanged for cash or applied to a past order.
All discount codes and promotions are subject to the conditions we state when we offer them. We can end a promotion at any time. Codes obtained from coupon sites or by abuse may be refused.
7. Using the products safely
Our fragrances are for external use only. Spray on skin or clothing. Keep away from eyes. Do not use on broken, irritated or freshly shaved skin. If irritation or a rash develops, stop using the product and consult a doctor. Patch test on a small area first if you have sensitive skin or known fragrance allergies. Keep out of reach of children and pets. Flammable: keep away from heat, flame and direct sunlight, and do not use while smoking. Store upright in a cool, dark place. Fragrance can mark some fabrics, leather and finished surfaces.
Our products are cosmetics. They do not treat, cure or prevent any condition, and nothing on this site is medical advice. Full ingredient lists, allergen information and how to report a reaction are on the Safety and ingredients page.
8. Our intellectual property
The name Twynela, the twynela wordmark, the circled t monogram and seal, The Turn, The First Turn, The Next Turn, Find Your Turn, "You know this one. Almost.", "Known scents, turned.", our fragrance names, formulas, packaging, photographs, text, quiz and site design belong to Twynela LLC and are protected by trademark, copyright and trade secret law. You may browse the site and share links to it. You may not copy, scrape, reproduce, sell or use any of it in your own products, listings or advertising without our written permission.
9. Other people's trademarks
The names of other fragrances and brands that appear on this site are trademarks of their owners. We use them only to identify, truthfully and in plain words, the scent direction that inspired one of ours. Their owners have not approved, sponsored or endorsed Twynela, and we have no affiliation with them. Our products are independent compositions, not copies, and we make no claim that they are identical to any other product.
10. Your content: reviews, quiz answers, The Next Turn
When you post a review, answer the quiz, send us a message, or take part in The Next Turn (submit a scent memory, vote, join the tester circle or propose a name), you keep ownership of what you wrote, and you give Twynela LLC a non-exclusive, perpetual, irrevocable, worldwide, royalty-free, transferable and sublicensable license to use, copy, edit, publish, translate and make products and marketing from it, in any medium, with or without your name as you choose. For The Next Turn this includes using your ideas, notes and names to develop, name and sell fragrances. We may do this without paying you, unless a specific program says otherwise in writing.
You promise that your content is yours, is truthful, and does not infringe anyone's rights or break any law. Do not submit anything confidential: submissions are not confidential, and we may receive similar ideas from others. We may remove content that breaks these terms or our Reviews policy, and we may decline to publish anything. Votes and feedback guide our development; they do not bind us to make, name or release any particular product. The full program rules are in the Next Turn terms.
11. Reviews
We follow the Federal Trade Commission's rule on consumer reviews. We do not write, buy or fake reviews, we do not suppress reviews because they are negative, and anyone who received a free product tells you so in their review. The details are in our Reviews policy.
12. Email and text messages
We send order emails to every customer. We send marketing email only if you sign up or buy from us, and every marketing email has an unsubscribe link. If we offer text messages, they are a separate program with its own Mobile messaging terms; consent to texts is never a condition of buying.
13. Your account
If you create a customer account you are responsible for keeping your login private and for everything done through it. Tell us at once if you think it has been used without your permission.
14. What you may not do
Do not use the site to break the law, infringe anyone's rights, send spam, upload malware, scrape or harvest data, interfere with the site's operation, place fraudulent orders, buy for resale without our written agreement, or misrepresent who you are. We may suspend or refuse service to anyone who does.
15. Third-party services
The store runs on Shopify, and payment, shipping, reviews, email and analytics are provided by third parties. Their services are governed by their own terms and privacy policies, which we encourage you to read. We are not responsible for their acts or omissions beyond what the law requires.
16. Disclaimer of warranties
EXCEPT AS EXPRESSLY STATED IN THESE TERMS OR REQUIRED BY LAW, THE SITE AND THE PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT A FRAGRANCE WILL PERFORM ON YOU AS IT DOES ON US. Some states do not allow some of these disclaimers, so parts of this section may not apply to you.
17. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, Twynela LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL, ARISING FROM THE SITE OR THE PRODUCTS, HOWEVER CAUSED. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO AN ORDER IS LIMITED TO THE AMOUNT YOU PAID US FOR THAT ORDER. These limits do not apply to liability that cannot be limited by law, including for death or personal injury caused by our negligence or by a defective product.
18. Indemnity
If your breach of these terms, your content or your unlawful use of the site causes a claim against us, you agree to defend us and cover the resulting losses and reasonable legal costs.
19. Disputes: talk first, then arbitration
Talk first. If you have a problem, email hello@twynela.com with your order number and what went wrong. Most problems are fixed within a few days. If we cannot resolve a dispute within 30 days of your written notice, either of us may start arbitration or a small claims case as described below.
Arbitration. Any dispute between you and Twynela LLC arising out of or relating to these terms, the site or a purchase will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this section. Arbitration may be conducted by phone, video or written submissions, or in the county where you live. We will pay the AAA filing and arbitrator fees for claims under $10,000 unless the arbitrator finds the claim frivolous. The arbitrator may award the same individual relief a court could.
Exceptions. Either of us may bring an individual claim in small claims court instead, and either of us may seek a court order to stop infringement or misuse of intellectual property.
No class actions. You and we agree to bring claims only in an individual capacity, not as a plaintiff or class member in any class, collective or representative proceeding. If this waiver is found unenforceable for a particular claim, that claim will be heard in court, and the rest of this section still applies to everything else.
Opt out. You can reject this arbitration section by emailing hello@twynela.com with the subject "Arbitration opt-out", your name and address, within 30 days of your first purchase. Opting out does not affect any other part of these terms.
Law and venue. Texas law governs these terms without regard to its conflict-of-laws rules. Any matter that is not subject to arbitration will be heard in the state or federal courts located in Travis County, Texas, and you consent to their jurisdiction, except that you may bring a small claims case where you live.
20. Notice to California residents
Under California Civil Code section 1789.3, California users are entitled to the following notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210. Our contact details are at the end of these terms.
21. General
These terms, together with the Privacy Policy, Shipping Policy, Refund Policy, Reviews policy, Next Turn terms and any program terms we publish, are the whole agreement between us about the site and your orders. If part of these terms is found unenforceable, the rest stays in force. Our not enforcing a term is not a waiver of it. We may assign this agreement in connection with a sale or reorganization of our business. Events beyond our reasonable control, such as carrier disruptions, severe weather or supply shortages, excuse delays caused by them. We may update these terms by posting a new version with a new effective date; the version in force when you order governs that order.
